Standard Terms and Conditions for Wedding Photography by Bow Tie and Bunting
The Photographer (Charles Henderson, trading under Charles Henderson Photography
) agrees that every effort will be made to provide high quality photographic services and that the Photographer will at all times behave in a manner that is applicable to the occasion.
2. License and Coverage.
a) The Photographer shall be granted artistic license in relation to the poses photographed and the locations used, and the Photographer´s judgment shall be deemed correct.
b) The photography schedule and selected methodology are designed to accomplish the goals and wishes of the Client in a manner enjoyed by all parties involved. The Photographer is not to be held responsible for non-availability of subjects or adverse conditions which may delay the progress of proceedings, preventing the coverage of certain specified shots.
c) The Photographer should be made aware or any cultural or faith aspects of the wedding that will enable production of the best pictures for the day.
d) The Photographer is limited by the requirements or guidelines of the ceremony official or the reception site management. The Client agrees to accept the technical and artistic restraints their imposition may have on the work of the photographer. Negotiation with the officials for moderation of guidelines is the Client’s responsibility; The Photographer will offer technical recommendations only.
3. Image Reproduction.
a) Due to the wide range of clothing colours available today, it is sometimes impossible to record on camera the exact colour of materials as perceived by the human eye. When processing images, the Photographer will endeavour to achieve a pleasing overall colour balance based on natural flesh tones.
b) It is understood that some colours may not remain consistent throughout a set of photographs owing to variations in lighting conditions. It is also understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range within a subject. The colour balance of prints made at different times or in varying sizes may also be variable.
c) Images are edited on a colour calibrated computer monitor and printed using professional photographic labs. When viewed on alternative monitors it is understood that images may appear differently and that prints will not match images rendered on any particular computer monitor.
d) Where images are made available for use on a DVD player reasonable steps are taken to ensure compatibility, but cannot be guaranteed.
4. Conduct and Insurance.
The Photographer will not tolerate verbally or physically abusive behaviour, nor will he share his time or compete with guest photographers for the attention of the subjects. Unchecked guest conduct that interferes with photography may seriously affect the quality of the photographs taken. If the Client is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer, it will result in the early or immediate departure of the photographer. The Client understands that in such an event, no refunds will be granted. However the Client agrees that the Photographer is not responsible for any damages, financial emotional or otherwise, that they might suffer, no matter however caused.
5. Copyright and Model Release.
All photographs, digital negatives or prints produced by the Photographer are protected by The Copyright Act 1988 (all rights reserved) and may not be reproduced in any manner (photographic, computer, internet or otherwise) without the Photographer's explicit written permission.
The Client hereby assigns and grants the Photographer and its legal representatives the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same providing that the images are used lawfully and without damage to the clients.
7. Bookings and Payment Requirements.
a) Any alterations to the booking, once details have been confirmed by the Client, may only be made at the discretion of the Photographer. If unable to accommodate alternative arrangements (e.g. change of ceremony date or venue) the Photographer is not liable to compensate the Client in any way.
b) To reserve the event date, the Photographer requires a minimum scheduling payment of £200. The Photographer will not reserve a date without receipt of said payment. Said payment is nonrefundable subject to paragraph 9.
c) The remaining balance must be received by the Photographer no later than 14 working days before the event date.
d) If an overnight stay is required the Client will meet the accommodation cost.
e) Any additional time taken on the event day over the contracted times is charged at £150 per hour. The Photographer will inform the Client before any extra time is incurred.
f) Travel costs – Weddings held within a 2hour drive, or 100 miles (whichever is greater) from Bicester, Oxfordshire will incur no additioanl charge. Additional distance over 100 miles is charged at 45ppm, or additinal time at £5/15mins. Travel time and mileage is calculated using Google Maps.
8. Data Privacy.
Bow Tie & Bunting will not share or sell your contact details to any other company.
a) In the event of cancellation by the Photographer, the Photographer´s liability shall be limited to a full refund of any deposits and fees already paid.
b) The Photographer will endeavour to contact other photographers in the unlikely event that he is unable to attend your booking. However it may prove difficult or impossible to find a suitable replacement photographer at short notice or at the same price.
c) If the Client should have to cancel a booking the following terms apply and any fees due will become payable immediately:
ii. The Client is entitled to a full refund of the £200 scheduling payment if the cancellation is received within 14 days of booking.
iii. Monthly (or quarterly) installments towrds the final total fee are accepted. The Client is entitled to a full refund of any monies paid (minus the scheduling payment) up to 90 days prior to the wedding date, should the wedding be cancelled.
iiii. Cancellations made within 90 days and greater than 14 days of the wedding
entitle the Client to a refund of 75% of any monies paid (except the scheduling payment).
iiv. Cancellations, made within 14 days or fewer of the wedding incur the full cost of the photographic service booked, including optional additional photographers booked. There will be no charge for other optional extras.
v. Where the photographer is able to rebook the date with an equivalent booking, all monies paid apart, from the £200 scheduling payment and any fees for additional photographers, will be refunded accordingly.
vi. In the event of postponement, then at the discretion of the Photographer, and subject to availability, all money paid may be applied to the new wedding.
vii. It is essential to inform the photographer as soon as possible of any changes of venue, times, or contact details etc.
Whilst every care is taken, this contract is subject to alteration or cancellation by the photographer in case of events beyond his reasonable control, i.e Act of God, War, Fire, Flooding, Accidents on Roads or Railways etc. In the unlikely event that total mechanical/electrical failure should occur to the Photographer’s equipment or personal transport and the Photographer is unable to provide the Client with the agreed photography services and/or products, the Photographer’s liability shall be limited to a full refund of all monies paid. Re-shoots may be arranged if practicable but the Photographer will not be responsible for any further costs.
Bow Tie and Bunting reserves the right to change services, offers and prices at any time.
